Welcome to Creation OS. By accessing or using our website, platform, and services (collectively, the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy.

1. Description of Service

Creation OS is an interactive world-building and storytelling platform. The Service utilises advanced generative technology to help users create, explore, and play within richly detailed fictional worlds across any genre or setting.

2. Accounts and Authorisation

To access the core features of the Service, you must register using a supported third-party authorisation provider (e.g., Google). You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorised access to your account.

3. Billing, Subscriptions, and Virtual Credits ("Spark")

3.1 Subscriptions: The Service offers a subscription plan ("Creation OS Pro") at a flat monthly rate. Subscriptions are billed on a recurring monthly basis. You may cancel your subscription at any time; however, you will retain access to the Service until the end of your current billing cycle.

3.2 Virtual Credits ("Spark"): The Service utilises a virtual credit system ("Spark") to meter the usage of our generative tools.

  • Spark is allocated monthly as part of your active subscription.
  • Additional Spark may be purchased as one-off packs in fixed denominations.
  • Spark has no real-world monetary value, is non-transferable, and cannot be exchanged for cash.
  • Unused allocated monthly Spark does not roll over to the next billing cycle. Purchased top-up Spark remains valid for the lifetime of your active account.

3.3 Action Costs and Spark Consumption: Different actions within the Service consume varying amounts of Spark based on computational complexity. Action costs are displayed in the Spark Merchant (accessible via the Spark indicator in the application) and in the Guide. We reserve the right to adjust action costs with reasonable notice to users.

3.4 AI-Generated Content Quality: The Service uses advanced generative AI models. While we strive for high-quality output, AI-generated content may occasionally produce unexpected, inaccurate, or unsatisfying results. Spark is consumed when a generation request is processed, regardless of whether you are satisfied with the output. This reflects the computational cost of processing, not the quality of the result. We continuously improve our models and prompts to minimise unsatisfying outputs. If you experience persistent quality issues, please contact support.creationos@gmail.com for assistance.

4. Refund Policy

4.1 General Policy: Creation OS is a digital service. We do not offer refunds for change of mind, dissatisfaction with the Service, or failure to use purchased Spark credits. By completing a purchase, you acknowledge that you have reviewed the Service and are making an informed decision.

4.2 Australian Consumer Law: Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation that cannot be excluded by agreement. If the Service has a major failure as defined under the Australian Consumer Law, you are entitled to a refund or replacement. A major failure includes situations where the Service is substantially unfit for its common purpose, is unsafe, or is significantly different from what was described.

4.3 Faulty Service: If the Service experiences a verifiable technical fault that prevents you from using purchased Spark credits (for example, a server outage that consumed Spark without delivering any output), you may request a refund or credit by contacting support.creationos@gmail.com within 14 days of the incident. Refund requests are assessed on a case-by-case basis. We may offer account credit in lieu of a monetary refund at our discretion, where permitted by law.

4.4 Subscription Cancellation: Cancelling your subscription stops future billing. You retain Pro access until the end of your current billing period. No partial refunds are issued for unused days within a billing cycle.

5. Intellectual Property and Generated Content

5.1 User Inputs: You retain all ownership rights to the original concepts, text, and prompts you input into the Service ("User Inputs").

5.2 Generated Content: The Service utilises third-party technology providers to generate text, data, and images ("Generated Content"). We claim no ownership over the Generated Content resulting from your User Inputs. You are granted a worldwide, non-exclusive, royalty-free licence to use, display, and commercialise the Generated Content within your account, subject to the terms of our third-party providers.

5.3 Platform IP: We retain all rights, title, and interest in the Service itself, including the source code, UI/UX design, visual assets, and the underlying proprietary architecture.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Generate, store, or distribute content that is illegal, grossly offensive, or violates the rights of any third party.
  • Attempt to reverse-engineer, decompile, or extract the source code or underlying system prompts of the Service.
  • Use automated scripts, bots, or scrapers to access the Service or drain Spark balances.
  • Interfere with or disrupt the integrity or performance of the Service infrastructure.
  • Generate, attempt to generate, or solicit content depicting, describing, or facilitating the sexual exploitation, abuse, sexualisation, or grooming of minors in any form, whether explicit or implied.

We reserve the right to suspend or terminate any account found violating this Acceptable Use Policy without prior notice or refund.

6A. Zero-Tolerance Policy: Child Safety

This section constitutes an absolute, non-negotiable platform boundary.

Creation OS maintains a strict zero-tolerance policy regarding any attempt to use the Service to generate, solicit, or facilitate content that sexualises, exploits, abuses, or grooms minors. This includes, but is not limited to: sexual content involving characters described or implied to be under 18 years of age, grooming scenarios, exploitation narratives, and any content that could constitute child sexual abuse material (CSAM) under applicable law.

Automated Detection and Logging: The Service employs automated content filtering systems that detect and flag prohibited content in real time. When a violation is detected:

  • The offending request is immediately blocked and will not be processed.
  • Your user ID, account details, the full text of the offending prompt, and associated metadata (IP address, timestamp, campaign ID) are permanently logged in our security database.
  • Your account is subject to immediate suspension or permanent termination without notice or refund.

Reporting to Authorities: Creation OS will cooperate fully with law enforcement agencies and will report flagged content and associated account information to the relevant authorities, including but not limited to: the Australian Federal Police (AFP), the Australian Centre to Counter Child Exploitation (ACCCE), the National Center for Missing & Exploited Children (NCMEC), and any other applicable jurisdiction-specific agencies. We are committed to assisting investigations and prosecutions to the fullest extent permitted by law.

Scope Clarification: This policy targets the deliberate exploitation and sexualisation of minors. It does not restrict legitimate storytelling that involves children in age-appropriate, non-exploitative contexts (e.g., rescuing children in peril, child NPCs in a fantasy world, dark narrative themes involving orphans or missing children). Our detection systems are calibrated to distinguish between legitimate gameplay and prohibited content.

By using this Service, you acknowledge and accept that your interactions are subject to automated safety monitoring, and that any violation of this policy will result in permanent account action and potential referral to law enforcement.

7. Copyright and DMCA

Creation OS respects intellectual property rights. If you believe that content available through the Service infringes your copyright, you may submit a takedown request to support.creationos@gmail.com with the following information:

  • Identification of the copyrighted work you believe has been infringed.
  • Identification of the content on our Service that you believe is infringing, with enough detail for us to locate it.
  • Your contact information (name, email address).
  • A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf.

We will investigate valid takedown requests and remove or disable access to infringing content where appropriate. Repeat infringers may have their accounts terminated.

8. User-Generated Content and Liability

You acknowledge that while Creation OS facilitates your generative requests, we employ automated safety systems to detect and prevent prohibited content as described in Section 6A. Beyond these automated safety measures, we do not pre-screen or endorse the User Inputs or Generated Content within your account. You assume all legal responsibility and liability for the content you generate, including any claims of copyright infringement, defamation, or violation of third-party rights.

9. Indemnification

You agree to indemnify, defend, and hold harmless Creation OS from any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your generation of any infringing or unlawful Generated Content.

10. Limitation of Liability

To the maximum extent permitted by law, Creation OS and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. In no event shall our total aggregate liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Western Australia.
